This policy governs our processing of all information provided to us. You are asked to please read it carefully. If you do not agree to our processing of your information as outlined in these terms & conditions, please do not submit any information to us.Any time you provide information to us, you therewith expressly consent and agree to these terms & conditions.

Are you a client?
As a potential or existing client of K2 you hereby warrant that you (as a representative of your organisation or as an organisational body) will treat all information passed to you as confidential and specifically will not use information received via K2 relating to candidates for any purpose other than in fulfilling specific job opportunities known to K2.

You agree not to share, copy or transmit any confidential information to a third party, unless you have the expressed written consent of the candidate prior to release.

Should you use any candidate details or other confidential information obtained via K2 for any other purpose other than that for which it was provided you will indemnify and hold blameless K2 for any liability that should arise (as applicable under the full extent of the governing law).

Regarding all information provided by you to us you consent that we process this information for the purpose of filling the open position. Further you consent to us that the information provided to us is shared with other companies of our group and may be sent outside Switzerland and/or the EU.

The mentioned consent given to us can be withdrawn by you at any time; such withdrawal has to be notified in writing or by fax to the attention of the Legal Department, c/o K2 Partnering Solutions Ltd (address as per above), fax number +44 (0) 207 751 2203.

Are you a candidate?
As a candidate you are bound by our terms and conditions, and by using our services you hereby understand and consent that your information (including personal details) may be solicited by us and processed within our group for purposes of securing you a position with our current and future clients (both in and outside the EU borders), and to keep you informed of services offered by us, our affiliated companies and or our business partners.

K2 is registered as a data controller in the EU and under US Safe Harbor rules. We ensure that the information you supply to us is processed with skill and care, in line with data protection requirements. K2 will collect information in order to seek a position on your behalf. This information will include the information you supply to us on your CV (which may include, for example, name, address, experience, references and education). You consent to us using the information provided by you (including, without limitation, sensitive personal details) and seeking information from references and expert advice to the extent offered by you in order to seek a position on your behalf and in accordance with these terms and conditions.

Whilst K2 will not regularly seek any “sensitive personal details” (which may include, for example information relating to race/ethnicity, criminal convictions, security clearance levels, health or disabilities, trade union membership), if you choose to provide any such information to K2, you are hereby providing your explicit consent to the processing of such information in accordance with these terms and conditions.

All information provided may be shared with our clients and other companies within our group at K2’s discretion and therefore may be sent outside Switzerland or the EU to which you consent. Upon circumstances where your information is sent outside of the EU and Switzerland we shall take reasonable steps to ensure that the receiving party has an adequate level of data protection.

You consent to us processing your data also after the relationship with K2 has been terminated. In any case after an appropriate time period we will contact you and ask if you wish for your information to be maintained on our database (see below under Disclosure).

You any time have the right to withdraw any specific consent given to us under these terms & conditions. Such withdrawal has to be notified in writing or by fax to the attention of the Legal Department, c/o K2 Partnering Solutions Ltd (address as per above), fax number +44 (0) 207 751 2203.

It is your responsibility to supply information that is complete, accurate and current to be used in the process of securing positions. Please inform K2 promptly of any changes to your information.

You accept that while K2 will use its reasonable endeavours to find a suitable position for you, under no circumstances does K2 guarantee that a) K2 will find you a suitable position; b) our clients will request information on your profile; or c) our clients are obliged to interview or hire you.

K2 in no way warrants any terms and conditions that may be made via K2 by a client for a potential position and furthermore you hereby waive all claims against K2 whereby we are unable to find you a suitable position or secure terms or duration of any position.

It is hereby acknowledged that your current employer may be a current or future client of K2 with access to information from K2 databases, and you unconditionally waive any and all claims you may have against K2 as a result of any loss you may suffer as a result of information being provided to your employer.

Disclosure
In line with the Data Protection laws, upon written request we will provide information in writing about the information stored on our database and other computerised systems. This may be subject to any applicable fees chargeable at the time for disclosure.

If you do not wish us to hold your information, you are entitled to tell us at any time and we will remove all such information from our database, subject to any administration charges applicable to the jurisdiction.

If we have no contact with you then following the expiry of a reasonable period as we consider appropriate we will archive your information or may delete it.

After an appropriate period we will contact you and ask if you wish for your information to be maintained on our database. If you do not indicate by responding to our request that you wish to have your details retained then we may archive your details.

We reserve the right to transfer your information to a third party in the event of a sale, merger, liquidation, receivership or transfer of all or substantially all of the assets of our company provided that the third party agrees to adhere to our terms and conditions and provided that the third party only uses your information for the purposes that you provided it to us. You will be notified in the event of any such transfer and you will be afforded an opportunity to opt-out.
